The EEOC is a federal agency that receives and investigates discrimination charges. The EEOC also receives and investigates harassment (including hostile work environment) and retaliation charges. The EEOC’s formal name is the Equal Employment Opportunity Commission. BOLI is a state agency for Oregon that also receives and investigates discrimination, harassment and retaliation charges. BOLI’s formal name is the Bureau of Labor and Industries.
When workers file charges with the EEOC or BOLI, the EEOC or BOLI investigates. The EEOC and BOLI are neutral in their investigations, which means neither advocates for workers. Also, the EEOC and BOLI investigate only to the extent they have the resources (including time) to do so. Before workers file charges with the EEOC or BOLI, workers should strongly consider hiring an employment law attorney to represent them. Such representation includes investigating the claims, researching other potential claims and then putting together a charge based on facts and the investigation as provided for under the law.
